Welcome to Pool Pro. By using our platform, including the website, mobile app, and related services (collectively, the “Platform”), you agree to comply with these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform. These Terms may be updated periodically, and your continued use of the Platform constitutes acceptance of any changes.

1. Account Responsibilities

  • Security: We take security seriously and implement industry-standard measures to protect your account. However, it’s important that you also take steps to safeguard your login credentials (such as your password). You are responsible for all activities that occur under your account, so please use strong passwords and avoid sharing your login information with others.
  • Unauthorized Access: If you suspect any unauthorized access to your account, please notify us immediately. While we strive to keep the platform secure, Pool Pro is not liable for any losses or damages resulting from unauthorized use of your account due to your failure to safeguard your login credentials.
  • Safety First: We encourage you to use the platform responsibly. Please avoid using the app while driving or engaging in activities that could be unsafe. Pool Pro is not responsible for accidents, injuries, or damages caused by distracted use of the platform.

2. Payment Terms and Subscriptions

  • Pool Pro operates on a subscription basis with different plans that pool service businesses can choose from. By subscribing, you agree to the pricing, fees, and billing schedules presented at the time of subscription.
  • All payments are processed via Stripe. By using Stripe, you also agree to Stripe’s Terms of Service and Privacy Policy.

3. Dispute Resolution for Payments

  • Pool Pro is not responsible for resolving payment disputes between customers and pool service providers. Such disputes must be settled between the involved parties.
  • In the event of a disputed transaction or chargeback, it is the pool service provider’s responsibility to resolve the issue. Pool Pro will assist in issuing refunds only when required or appropriate, but Pool Pro is not financially liable for disputes.

4. Convenience Fees and Transaction Policies

  • Pool Pro may charge convenience fees for payments processed through the Platform. These fees will be clearly disclosed prior to transaction processing.
  • In cases where payments fail or Stripe services experience outages, Pool Pro is not responsible for any losses, delays, or damages incurred by users or pool service providers.

5. Privacy and Personal Information

  • Your personal information is managed according to our Privacy Policy. By using the Platform, you consent to the collection, use, and processing of your personal data as outlined in that policy.
  • We do not share or sell your personal information to advertisers or third-party marketing agencies.

6. Limited Liability

Pool Pro is not responsible for:

  • Indirect, incidental, or consequential damages that result from the use of the Platform.
  • Losses due to technical issues with third-party services such as Stripe, Google Maps, or Twilio.
  • Any damages resulting from a user’s failure to comply with the Terms, such as using the Platform while driving.

You use the Platform at your own risk. The Platform is provided “as is” without warranties or guarantees of any kind.

7. Intellectual Property

  • All trademarks, service marks, and logos on the Platform are the exclusive property of Pool Pro or its licensors. You may not use these marks without explicit permission.
  • Any content you upload or submit to the Platform (e.g., feedback, reviews, or photos) grants Pool Pro a perpetual, royalty-free, and sublicensable right to use that content in connection with the Platform.

8. Termination and Suspension

  • Pool Pro reserves the right to suspend or terminate your access to the Platform at any time, without prior notice, for any reason, including violation of these Terms.
  • Upon termination, you will no longer have access to your account, and any content you have uploaded may be deleted from our system.

9. Changes to the Terms

We may update these Terms from time to time to reflect changes in our services or legal obligations. Any significant updates will be communicated to users via email or through a notification on the Platform. Your continued use of the Platform constitutes acceptance of the updated Terms.

10. Governing Law and Arbitration

These Terms are governed by the laws of the State of California. Any legal disputes will be resolved through binding arbitration as set forth by the American Arbitration Association (AAA), with hearings to be held in Riverside County, California.

Class actions are prohibited. You agree to resolve any dispute individually and not as part of any class or collective action.
